1. Binding Agreement

 

These generated content terms of service constitute the whole binding agreement between you and Fascinated Presents, located in England. When we refer to ourselves (“we”, “us,” or “our”), we mean our business Fascinated Presents.

Personal information”- Details provided by you to us, such as: first name, last name, email, country, city, debit card details, delivery address, billing address, postcode, city and telephone number. “Product(s)”- An item offered with a discount or on stock availability. “Product description”-Details of individual package of the product(s). “Users”-Users who use our website or are accessing the website without being a customer. “We”, “us”, “our”- Referred to as Fascinated Presents. “You/your”- Refers to you as a customer. “Terms”- (also referred to as “Terms of service”) Means these terms of service. “Miscellaneous name”- Seller name, sales representative or sole trader, which runs and owns the entire business “Fascinated Presents,” owner of the website, data controller of these policy “terms” cookie policy and privacy policy, data processor, photographer of Fascinated Presents owned images/videos, marketing management/marketing administrator, stock manager, office administrator and packer. (It means the owner of Fascinated Presents who runs the business and does all the work from start to end. “ Whole agreement”- It includes “terms,” “cookie policy,” and “privacy policy.” Legal documents”- Policies which includes laws. “Content”- Information written through the website about products, sales, news, reviews, feedback, and information about the business. ”Consent”- You give permission for us to collect your personal data. “Agree”- When you provide your consent that means “Agree”. “Event”- The day when the legal action is placed. “Data Protection Representative”- Responsible for being data controller and data processor. “Limit of stock”- The products displayed on our website could have a small amount of quantity on our stock or have it for a limit time, or we may not get it a again. “Visitor”- Is any person or any unique user or an internet user who visits our website or mobile site.

 

3. About Fascinated Presents

 

This website is owned and operated by Fascinated Presents. The business is located in England and uses the trading website www.fascinatedpresents.com to sell our accessories. We use the same name “Fascinated Presents”, which appears on our legal documents. Fascinated Presents is an international online store (sole trader). The business address can be found on the return page if you have a return, fill out the return form, click submit, and a return address will pop up. The miscellaneous name (sales representative) also known as sole trader will be found on the top of your invoice.

 

4. Links to other policies

 

Any personal data collected by Fascinated Presents will be used in accordance with our privacy policy and cookie policy.

5. Consents

 

Every time you give your personal information to us, we will ask you to give your consent by using a checkbox. When you sign up for email, you will receive sale, discounts, newsletters or any updates to our policy. Emails sign up is free and optional. When you make an free account with us, you will get access to your personal account. If you need to contact us, then use the two contact forms provided on our website, and we will answer back within 2-3 working days. Whenever you buy our product on our website, you will get an confirmation on your email. We also ask for consent that you have read our terms, privacy, and cookies policy before checkout. You can choose to leave a feedback on our website so other users can see the feedback of our product which will be displayed on our reviews page but not all feedback will be visible for users. To use our website you also need to give consent that you have read and understand these “terms”. When user click into our website there will be displayed a cookie banner which will ask for your consent to accept so it can use your data for advertising and analytic cookies so we can improve or grow our business. You can also change the settings of our cookies or reject. For any of these consent we collect, we will ask for personal information, password, date, product name, price of products, rating of our product, feedback of our product, and your message to us.

These “terms” of agreement or it's formation, shall be governed by and construed in accordance with English law.

 

7. Prices

 

All products are exclusive of vat for UK and EU countries. You only pay for the product and no extra fee for the UK. For EU countries, you pay for the product, plus £6.50 extra for postage for orders under £25. For £25 and over that amount of an order, you get free delivery in EU countries. Product prices and fees can change at any time, from time to time.

 

7.1 Currency

 

The main currency on all products are pounds sterling. You can choose the currency you want to pay in by using the currency converter provided on top of the website.

 

7.2 Payment

 

The payment method we use on our website is PayPal only. Please note: Read these clauses 7.3 (pay later by PayPal), 7.4 ( pay now by PayPal) and 7.5 ( Pay by PayPal credit) very carefully if this apply to you before you make any payment through PayPal. For all 3 payment options through PayPal, you can choose to cancel ( read clause 17.2 Cancellations rights) or return ( read clause 17.1 Return rights) your order.

 

7.3 Pay later by PayPal

 

You can only use this payment option if you live in these 7 countries; Australia, France, Germany, Italy, Spain, United Kingdom or United States.

 

7.4 Pay now by PayPal

 

This payment option can be use by all the countries described on my website (read shipping & delivery policy).

 

7.5 Pay by PayPal credit

 

This payment option is only available for these 2 countries; United States and United Kingdom.

8. Secure payment

Your payment is secure with us. You will find the 'Secure Payment' badge at checkout, beneath the total price.

9. Age restriction

 

You must be at least 18 years old to purchase our products or use PayPal online through our website. By placing an order, users confirm that they meet this age requirement. We comply with the Data protection Act 2018 (DPA 2018), UK GDPR, and EU GDPR, which require individuals in the UK and EU to be of legal age to provide their own personal data. To agree to our terms of service and privacy policy, users must also meet the minimum age of 18. If a child from the UK is under the age of 13, and a child from the EU is under the age of 16, they need parental consent to process their personal data. If we find out that you are not the correct lawful age as you promise, we will immediately remove or delete your account with us. ​

10. Third party

 

On our website we have provided third party social media icon on top right side in the header. Our payment service is provided on our website when your final order have been decided by you; when clicking pay now, it will link you to the third party website (read there policies). When you have submitted your order, you will be notify by email about your order from our third party payment service. When your order have been shipped to our courier service, you will receive from us information about your order which includes tracking number. Our courier service will notify you directly or through us by email when your order have been delivery to your address. If you want to be part of our website and have an account, you can choose three options to log in with: Your personal user name and password for our website use only, Facebook or your google user name and password.

These third party described in our terms of service may direct you through a link to third party website. Make sure any comment, picture, videos, and advertisement on the third party social media or any of your personal data provided on our third party payment service or social media login or google login details on their website or your email which you provide to us when you placed your order are correct as it is not our responsibility and you have to read their policies on their website.

 

11. Error

 

If any error is found in the price of the products you have ordered or in the delivery charge, we will inform you as soon as possible through email ( read clause 28.1 other inquiries) .

 

12. Placing orders

 

You can only place a order online if you agree to the “terms” and other policies.

 

12.1 How to order

 

Add the product you want to purchase to your cart, if you want to buy later together with your other products or buy now if you are complete sure about your order. Enter your delivery address, enter your billing address and payment information. At last, you have to accept the terms of service, privacy policy, and cookie policy before you can continue.

 

12.2 Order confirmations

 

When you have placed an order and submitted it, you will receive two confirmations by email, one from our website and another from our payment service (two emails).

 

12.3 When will we notify you about your order

 

As soon as the goods are shipped, you will also be notified by email about your order, which includes your tracking number link. The email will be sent from us to you (third email). When your order has been delivered to your address, you will again be notified by email either by us( read clause 28.1 other enquiries) or directly from courier service (read clause 10. third party), you will receive four emails in total.

 

13. Our communication with you

 

We will communicate with you through email when you sign up for account, for email sign up, every time we send newsletter, inform you about discount/offers/sale, new products coming up, any questions from you to us through contact forms or live chat, update to the policies, when you buy products, and notify you about shipping and delivery.

 

14. Sale

 

Users can find sale on our website homepage. Users can sign up for email campaigns and get sale advertisement through emails. You have the same rights to return sale items as you have for full priced items (read return policy & refund policy).

 

14.1 Discount

 

Any discount will be displayed on our website or send through email if you have sign up to receive emails.

 

14.2 Sale promoter

 

The sale promoter of our discounts is the business with the trading name Fascinated Presents.

 

15. Shipping

 

As soon as we receive your order and payment online, we will pack your order the same day and send you a confirmation email. Afterwards, we will ship the order to the courier service the next working day.

Due to Covid-19 and bad weather in many countries, there may be delays in shipping and deliveries.

Please make sure your delivery address and billing address are correct before we ship your order to the courier service. If you need to change your delivery address, you can contact us at fp@fascinatedpresents.com, write “Policy” in the subject line. Once the order is shipped to the courier, it is their responsibility to take care of your package. If any damage occurs during shipment, we are not responsible for the package once it is with the courier.

 

16. Delivery info

 

Delivery fee will be displayed at checkout, and you can also find info about delivery fee in the shipping & delivery policy.

 

You will receive a confirmation on your email of your delivery process from when your order is placed until you receive it.

 

As soon as your product arrives at your address, it will be your responsibility, and we will not be responsible for the product anymore.

Offers on delivery will also be displayed at the top of the homepage for delivery in UK and EU countries.

 

16.1 Delivery time in UK

 

Delivery times in the UK region are 2-4 days from the date you place your order until your package arrives at your address. Delivery times are approximate only.

 

16.2 Delivery fees in UK

 

Delivery fees in UK is free of charges.

 

16.3 Delivery time in EU countries

 

Delivery times are 4-6 days in EU countries from the date you place your order your package arrives at your address. Delivery times will be approximate only.

 

16.4 Deliveries fees in EU countries

 

Deliveries fees in EU is £6.50 if you spend less then £25. Orders over £25 is free of charge.

 

17. Info about return, cancellation and refund

 

All info below is about the return of your item you bought, cancellation rights and refund.

 

17.1 Return rights

 

To make a return, you should send your order back within 14 days from that date you informed us. By using the return form we have provided on our website, you can read the return policy. You can not return your products or items if they were damaged during shipment by the courier or if you already knew about the faulty product or item before you bought it. We only accept return from you who have bought the products, which means orders placed by you or payments made by you. We also ask you for proof of your purchase you want to return. We accept purchase receipts or purchase invoice or packaging(like your proof of your name, delivery address, post code, city, country plus a image of your item you bought from us or sale receipt or sales invoice).

 

17.2 Cancellation rights

 

You have every legal right to cancel your order within 14 days of receiving your order without giving any reason.

 

17.3 Refund rights

 

We offer full refund if you find out your item or product is faulty, not as described on the website or damaged or broken before it got shipped from us to you. You have the same rights to get full refund on our sale product or item which you find on our website. We will refund you soon as possible within 14 days of receiving your goods or products or items back.

 

18. Subscribe to newsletter, offers, new products, and sales.

 

On our website, you can sign up for free to receive email notifications about our news, coming up products, discounts, offers, sales, and updates to new policies.

 

19. Amendments

 

For any reason, including compliance with new laws, we may need to update the agreement from time to time. We will notify you of any changes by email, and you will be considered legally bound by the updated agreement one month after we have sent this notification. We do not provide any guarantees on our website, except as permitted by applicable law. It is your own responsibility and at your own risk for any device damage you might incur when accessing our website or platform.

 

Fascinated Presents is not responsible for any user content published on the website.

We can not guarantee that our services on our website are uninterrupted or error-free.

 

We will try our best to have most items in stock. However, we may be out of stock from time to time, as many of our products are limited in stock.

 

It is important to us that you feel happy with our products and the services we provide for you on our website. If there is any reason why you are not satisfied with the products you have ordered through our website, you can easily return them through our return form.

 

22. Limitation of liability

 

You strongly agree and understand that your use of, or inability to use, our website or services is absolutely at your own risk.

Our products bought by you, or services provided to you through Fascinated Presents, are provided on an 'as is' and 'as available' basis, without any representation, warranties, or conditions of any kind, whether express or implied, including merchantable quality.

 

Nothing in these “terms” shall affect or limit your rights under applicable law, or exclude or limit

our liability for: loss of life, injury, decease, hurt, or damage caused by our erroneous, deception, or any other issue where it is unlawful for us to exclude or limit our liability.

All the content on our website, including our three policies; terms of service, privacy policy, and cookie policy, will be in British English.

 

24. Intellectual property

 

We are the owner of the licensee of all intellectual property rights on our website, including images, videos, contents, logo, slogan, Fascinated Presents trading name, product names, packaging tape, shipping labels, and the whole agreement. All our work and materials with our trading name Fascinated Presents are protected by copyright laws and treaties around the world. All such rights are reserved.

You do not have any right to use any of our intellectual property rights described above for any advertisement, promotion, profit-oriented, money-oriented or trading purposes without a Licence from us.

 

25. Prohibited behaviors

 

You can only publish your content (such as feedback on our products) to our website if you have permission from us. We cannot guarantee that our website will be 100% secure or free from any bugs or viruses. You are responsible for configuring your information technology and computer programs to be safe and protected from viruses when using our website.
